Refund & Cancellation Policy

Important Notice

Please read this policy carefully before using our services. By accessing or using Truckage Group's platform, you acknowledge and agree to these terms.

1. Disclaimers & Warranties

The use of the services provided by Truckage Group ("Company", "we", "our") is at your sole risk. The services are provided on an "as is" and "as available" basis.

Platform Service Provider

You acknowledge and agree that the Company is a technology platform service provider and is not engaged in the provision, grant, or disbursement of any financial product. The Company does not act as a financial intermediary and does not collect, hold, or facilitate the collection of funds on behalf of users.

The Company is not registered with the Reserve Bank of India (RBI), does not hold any license to engage in financial activities, and is not a financial institution under the Companies Act, 2013, the Banking Regulation Act, 1949, or any other applicable laws in India.

The Company shall not be responsible or liable for any claims, damages, losses, or disputes arising directly or indirectly from payments made by users or their customers. Users are solely responsible for maintaining proof of sale or transaction records in electronic or physical form.

2. No Warranty

To the fullest extent permitted by applicable law, the Company expressly disclaims all warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Accuracy and reliability
  • Non-infringement
  • Uninterrupted or error-free service

3. Limitation of Liability

The Company, its affiliates, directors, officers, employees, or agents shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

  • Loss of profits or revenue
  • Loss of data or information
  • Business interruption
  • Loss of business opportunity
  • Any other commercial damages or losses

You agree to waive, release, and hold harmless the Company from any claims arising from your use or inability to use the services.

4. Indemnity

You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, and agents from any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your access to or use of the services
  • Violation of these terms and conditions
  • Infringement of any third-party rights
  • Your business operations or transactions
  • Any negligence or willful misconduct

5. Consent to Use Data

You agree that the Company may collect, use, and process your data in accordance with its Privacy Policy for the following purposes:

  • Service delivery and platform functionality
  • Analytics and performance improvement
  • Customer support and communication
  • Compliance with legal obligations
  • Fraud detection and security

The Company may disclose user data to law enforcement or government authorities if required under applicable laws or in response to valid legal requests.

6. Maintenance of Records

Users are required to maintain independent records of all transactions, including but not limited to payment receipts, invoices, and proof of delivery. The Company reserves the right to request copies of such records for audit, verification, or compliance purposes at any time.

7. Fees & Charges

The Company reserves the right to charge subscription fees, convenience fees, or transaction fees for the services provided. The applicable fees will be communicated to users in advance.

Failure to pay applicable fees may result in suspension or termination of access to the platform and services.

8. Cancellation & Refund Policy

UPI Transactions

  • UPI transactions cannot be cancelled once initiated due to their real-time nature.
  • If incorrect UPI ID or mobile number is entered, the Company shall not be liable for any loss or misdirected payment.
  • UPI transactions are processed in real-time. In case of delays or failures, users may contact support after a 30-minute cooling period.
  • Refunds for failed UPI transactions will be processed automatically by the payment gateway within 5-7 business days.

Debit / Credit Card Transactions

  • Users must report card-related transaction issues via email support within 48 hours of the transaction.
  • The Company will review and attempt resolution based on established escalation procedures with banking partners.
  • Refunds, if applicable, will be processed after transaction validation on a case-by-case basis.
  • Refund timelines depend on banking partners and applicable laws, typically 7-14 business days.

Subscription Cancellations

  • Subscription fees are non-refundable once the subscription period has commenced.
  • Users may cancel their subscription at any time, but will have access until the end of the current billing period.
  • No partial refunds will be provided for unused portions of a subscription period.

9. Jurisdiction & Dispute Resolution

Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Courts located in Bangalore, Karnataka shall have exclusive jurisdiction over all disputes.

Arbitration

Any disputes, claims, or controversies arising out of or relating to these terms or the services shall be resolved through binding arbitration in Bangalore in accordance with the Arbitration and Conciliation Act, 1996.

Arbitration Process

  • The arbitration shall be conducted in English language
  • Single arbitrator to be mutually appointed by parties
  • The arbitrator's decision shall be final and binding on all parties
  • Each party shall bear their own costs unless otherwise determined

10. Changes to This Policy

We reserve the right to update or modify this Refund & Cancellation Policy at any time. Changes will be effective immediately upon posting on our platform. Your continued use of the services after any changes indicates your acceptance of the updated policy.
